That is in the garage with the door shut,the engine off, and the stereo blasting. Got a battery tender and I’m sitting in the M3 with a beer listening to some tunes. Not going anywhere but I’m enjoying both my M3 and some beers at the same time. Can’t get a DUI if you don’t actually drive.

In car stereos have begun being so good... I can totally see your point.

I started hearing things in my Kia.... It was the details of the music that my jeep’s speakers didn’t pick up, neither did my Bluetooth earphones.

I honestly thought it was the car being broken but no... It was the stereo being awesome.

You can get non-driving DUI in America, too. Or get charged for sleeping in your car, while under the influence. Or any number of other rediculous, but potentially life-changing charges

I was asleep in the back seat when my friend, also asleep in the backseat was woken up by a cop. Keys were hidden outside of the car (because that may be a way to get around the stupid law..?) but my friend still got a large fine and almost a DUI. Sleeping because we didn’t want to ditch the car, and weren’t about to drive drunk.

Your state may well be different, but this wouldn’t be a great idea in New Mexico. The standard for a DWI in New Mexico is if the vehicle is under the control of an intoxicated person. There is no requirement for the vehicle to be driving, on a public road or for someone to even be in the driver’s seat. The case law plays out such that a person drunk anywhere in the vehicle can be a DWI if the keys are found anywhere in the vehicle or in the vicinity of the vehicle. DWI applies on private property in this state, too.

It means that in New Mexico, if one were to sleep it off in their car, they better have left they keys with the bartender or hid them in a bush a hundred yards away so that they are nowhere to be found when a bored cops wakes up the drunk person sleeping in the back seat at 3am.

If you get bored, having it read your text messages out loud in that female robot voice (with the european accent) can be a good time. While it’s handy, her inflections and pauses are never quite right.

I believe it does have to do with where the keys are but it seems kinda ridiculous to get in trouble if you clearly have no intent to drive.(with the keys purposely removed from ones person)

I’ve had so many people explain to me that they drove drunk because they would have gotten a DUI even just staying by their car. Still dumb obviously.... But it would be amazing to see cops and legislation that was actually aimed at protecting people and not just doling out sentences.
